This Privacy Policy (the “Policy”), applies to all subsidiaries owned and operated by African Remittance Company / SikaCash (“SikaCash, “We”, “Us”, “Our”). This Policy describes how we collect and use the Personal Data you provide on our website www.sikacash.com, and on our mobile websites and mobile applications. This Policy also applies for the Personal Data collected offline. The Policy describes the choices available to you regarding our use of your Personal Data and how you can access and update this data. Personal Data is data which can identify you, directly or indirectly, either from that data or from that data combined with other information that is in, or likely to come into, our possession, it includes data such as your name, your location or online identifiers, and as further identified in this Policy (“Personal Data”). By submitting your Personal Data to us you are accepting and consenting to the practices described in this Policy.

SCOPE OF PRIVACY POLICY

This Policy applies to Personal Data collected by us in connection with services we offer and transactions originating in the United States. This Policy applies to Personal Data we may collect via electronic channels and in hard copies (for example letters you post to us). Our website may contain links to and from the websites of our partner networks, advertisers and affiliates (for example Google, Facebook, Twitter, Linkedin, Instagram). If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any Personal Data to these websites. Our website is not directed at minors (those under the age of 18 years) and minors are not eligible to use our services. We ask that minors refrain from using our service or submitting any Personal Data to us.

Access to your personal information is provided to employees that need such access to process your Money Transfer transaction. All of our employees /agents undergo thorough background and credit checks irrespective of their duties and responsibilities.

Financial companies choose how they share your personal information. Federal law gives you the right to limit some but not all sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information.

Federal law gives you the right to limit only sharing for affiliates' everyday business purposes such as information about your creditworthiness, affiliates from using your information to market to you, sharing for non-affiliates to market to you. WHAT IS CONSIDERED PERSONAL INFORMATION?

Personal Information can be separated into two distinct categories. Public Personal Information is information about you that are available on the public domain such as your name, address and telephone numbers listed on a telephone directory.

Non-Public personal information is information that is considered private such as your Date of Birth, Social Security Number, Income, Employment Information and Driver's License Number. Your Company does not distinguish between the categories listed above. We consider Personal Information to include both public and Non-Public personal information.

The types of personal information we collect related to your Money Transfer transaction may include:

  • Social Security Number and Date of Birth for certain transactions meeting certain criteria
  • Transaction information, transaction history
  • Identification Information such as passport or government identification number
  • Contact information such as name, address, telephone number, or, email address

DATA WE COLLECT

We collect Personal Data which you disclose to us via online and offline: We collect your Personal Data and Personal Data of your beneficiaries when you create money transfer account with us by completing online forms. Personal Data we collect about you may include: name, surname, home address, email address, date of birth, mobile number, email address, credit and payment history, financial information, such as bank account numbers and credit/debit card numbers, and other Personal Data, including government identification numbers such as a driver’s license, state identification, passport, visa, Social Security and tax identification number, which may be required to complete the transaction. We do not knowingly collect and process sensitive Personal Data such as Personal Data revealing racial or ethnic origin, political opinion, religious philosophical beliefs, trade union membership and data concerning health and sexual preference.

How long is Personal Data retained?

Personal Data is used for different purposes and is subject to different standards and regulations. In general, Personal Data is retained for as long as necessary to provide you with the Services you request, to comply with applicable legal, accounting or reporting requirements, and to ensure that you have a reasonable opportunity to access the Personal Data.

To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements. For example:

  • Legal and Regulatory Requirements. SIKACASH shall retain Personal Data and transactional data for those periods required to comply with all retention and reporting obligations under applicable laws, including without limitation commercial, tax and anti-money laundering laws and regulations. Generally, this retention period will be a minimum of five years from the date of your transaction or the date our business relationship with you is terminated.
  • Customer Service (administration of customer relationship, complaint handling, etc.). SIKACASH may process and retain your Personal Data for as long as we have an on-going relationship with you. Once our relationship has ended (for example because the Services have been delivered and paid for in full, or you have exercised your right to withdraw from the contract), we will, subject to any retention requirements under applicable laws, erase or anonymise your Personal Data.
  • Marketing. Personal Data provided to us for marketing purposes may be retained until you opt out or until SIKACASH becomes aware that any such data is inaccurate.

If you send us correspondence, including e-mails and faxes, we may retain such data along with any records of your account. We may also retain customer service correspondence and other correspondence involving you, us and company, our partners, and our suppliers. We will retain these records in line with our Retention Policy

SECURITY

We at SikaCash practice the utmost diligence and take extensive care when working with your personal information. Our policy on protecting your personal information is embedded within our corporate culture. To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include established policies and procedures dictating physical security, logical access controls, firewalls and the use of encryption technologies and storage level encryption mechanisms. Our systems are tested for vulnerabilities regularly and undergo periodic external audits by Certified Information Systems Auditors and security professionals. The software and hardware to support the systems are situated at Tier 1 Data Centers that are reputed for employing the most stringent security standards. The information you provide to us in the course of conducting a Money Transfer transaction is reasonably assured to be transmitted and stored securely through storage level encryption mechanisms. We implement technical and organization measures to protect your Personal Data and follow data retention practices in line with applicable law

YOUR PRIVACY RIGHTS AND CHOICES

You have the right to request a copy of the personal data we’ve collected about you in the past 12 months. You also have the right to ask us to delete your personal data we have collected about you. If you want to see or delete your personal data, contact us. We will not deny you services, charge you different prices, or provide you with a different level of service solely for exercising your privacy rights.

If you request to see or delete your personal data, we’ll first need to verify who you are before we can respond to your request. If we can’t verify your identity, we will not be able to fulfill your request.

If you want to delete your personal data, you have choices:

  • Log in to your account and delete information you previously added. For example, you can delete your profile picture and non-primary addresses in your settings
  • Call us and request that we delete specific information
  • Close your account

If you close your account or request that we delete personal data, we still need to keep some personal data so we can:

  • Complete a transaction, provide goods or services you requested, or comply with our promises to you in the User Agreement or other contract you have with us
  • Detect and prevent malicious, fraudulent, or illegal activity
  • Protect your (or another person’s) legal rights, including the right to free speech
  • Manage our internal business processes that are reasonably related to your expectations when using our services

INFORMATION SHARING

We do not sell your personal data. However, we may share personal data about your transactions and experiences with our affiliates for their everyday business purposes. We may provide your Personal Data to trusted third parties who help us with our business activities such as processing your monetary transaction or offering customer service. These companies are authorized to use your Personal Data only as necessary to provide these services to us.

Why can't I limit all sharing?

Federal law gives you the right to limit only sharing for affiliates everyday business purposes: information about your creditworthiness, affiliates from using your information to market to you, sharing for non-affiliates to market to you. As you can see from the table above, we do not share your information for marketing purposes. Our sharing of your information is limited to processing your Money Transfer transaction.

Definitions

  • Affiliates Companies related by common ownership or control. They can be financial and nonfinancial companies. Our affiliates include companies with a SikaCash name such as Africa Remittance Company DBA SikaCash.
  • Non-affiliates Companies not related by common ownership or control. They can be financial and nonfinancial companies. Non-affiliates can include SikaCash agents or authorized delegates, or third parties as necessary to process transactions that you have requested or authorized.
